The concern related to inaccurate responses the operator had provided to the ATSB in relation to a number of safety issues which had been identified during an ATSB rail investigation.
The reporter expressed a safety concern regarding the response from the operator to the safety issues which were identified during an ATSB investigation.
The reporter advised that the operator had not implemented the changes to the procedures, as they had advised the ATSB in their response to the safety issues.
The operator reported that none of the allegations were true.
They also stated that they were most disappointed that the ATSB does not appear to have placed much rigour in assessing this allegation, in spite of many assurances throughout the consultation process in reference to introducing rail REPCON, that there would be rigorous assessment of allegations, before forwarding them to the concerned parties.
The ONRSR has undertaken a Compliance Inspection in order to establish the validity of the documented allegations, coupled with conducting an analysis of a range of documents supplied by the operator.
As a result of our compliance activities, we note some of the concerns raised in the report are valid. It is further noted the operator has recently taken steps to improve their systems in relation to the concerns raised.
The operator indicated a willingness to make considerable improvements in regard to the identified issues. At this current time, the ONRSR does not intend to take statutory action against the operator. However, we are closely monitoring the operator's effort to close out any non-conformance issues.
