The Bureau of Air Safety Investigation recommends that the Civil
Aviation Safety Authority:

(i) as a matter of some urgency, issue CAR 119. The Civil
Aviation Safety Authority proposed this action in its 14 July 1995
response to Interim Recommendation 950074. The response stated (in
part):

'Proposed new CAR part 119 dealing with operator certification
will make it clear that operations manuals must be approved prior
to issue of an AOC'; and

(ii) also approve subsequent amendments to operations manuals
before the amendments become effective, as it currently does with
maintenance manuals and training and checking manuals.

I refer to Investigation Report 9802830 on the accident
involving Cessna A185E, VH-HTS AT Calabash Bay, NSW on 26 July 1998
generating Recommendations R199801279, R19980280 and R19980284.

The ATSB recommends that CASA:



I. as a matter of some urgency, issued CAR119. CASA proposed this
action in its 15 July 1995 response to Interim Recommendation
950074.



II. [The response stated (in part):'Proposed new CAR Part 119
dealing with operation certification will make it clear that
operations manuals must be approved prior to issue of an
AOC'.]



III. also approve subsequent amendments to operations manuals
before the amendments become effective, as it currently does with
maintenance manuals and training and checking manuals



CASA acknowledges the intent of the above recommendations and
advises that these issues will be addressed in the proposed Civil
Aviation Safety Regulations (CASRs) Parts 119, 121A and 121B.



A Notice of Proposed Rule Making (NPRM) for each of these CASR
Parts will be released in April 2002. As part of the NPRM
consultative process, industry and interested parties are invited
to provide their comments and feedback to the proposed
regulations.
